Wedding planning – What you need to know




Documents and important information for a wedding in Italy
For Germans, Swiss, and Austrians, the legal recognition of a marriage in Bella Italia is straightforward.
Basically, you will need a few important documents for your wedding ceremony, which you should organize in advance. First, you will need an international birth certificate in a multilingual format. Second, you will need an identity card or passport and an international multilingual certificate of no impediment to marriage, which proves that you are both unmarried. If one or both of you are already divorced, a certificate of legal divorce is required. If one of you is widowed, you must present a death certificate for your deceased spouse.
For a civil wedding in Italy, a personal appointment takes place 1 to 2 days before the actual wedding ceremony. During this appointment, a protocol is signed in which the future spouses declare that there are no family or other obstacles to the marriage. The bride and groom, the responsible official, and, if necessary, a translator are present at this appointment. This can be your wedding planner. At this appointment, the original documents mentioned above are compared with those already submitted in advance by the wedding planner. After that, nothing stands in the way of the wedding ceremony.
In Italy, two witnesses per couple are required by law. If you have not planned for witnesses for your wedding, your wedding planner can organize them for you.




The marriage certificate
After your dream wedding in Italy, you will receive an internationally valid marriage certificate. You must then present this certificate to your local registry office in your home community. A name change and a separation of property can be registered and applied for in Italy.
Another important step is to present the marriage certificate to the registration office at your place of residence. In Bella Italia, you have the option of having the marriage certificate issued immediately after your wedding using the international “Modulo plurilingue” form. You can either take this form with you to Germany in person or have it conveniently sent to you by post.
Your registration office will then officially register the marriage using the documents provided. These steps are essential for the legal recognition of your marriage in both Italy and your home country.
An exception is Switzerland. The marriage in Italy will be reported to the Swiss consular representation in Italy so that the competent civil registry office in Switzerland can enter your marriage into its register.
Domestic or Italian law?
Foreign citizens can marry either under the laws and regulations of their own country or under Italian law.
If you wish to marry under Italian law, certain important legal impediments to marriage must not exist. A lack of legal capacity to marry or to enter into a marriage, as well as a lack of legal competence, must not be present. In addition, a temporary prohibition on entering into a new marriage and marriage between close relatives must be excluded. In Italy, marriage is possible from the age of 18 (or from the age of 16 if authorized by the juvenile court) upon presentation of a declaration of marriage capacity.
Civil unions are entered into only between persons of the same sex, while civil marriage is entered into between a man and a woman.

Types of marriage in Italy




Registry office or church
Under Italian law, only a civil marriage at the registry office is legally valid. As mentioned above, the prerequisite for getting married in Italy is registering at the registry office.
It is possible to get married officially at certain locations recognized as a “Casa Comunale.” These places (e.g., gardens, villas, museums, halls) have special permits and are included in a list of venues where institutional functions can be performed and marriages can be conducted by a registrar. Depending on the municipality, these institutional venues may include several locations, not just the registry office itself.
In Italy, thanks to the Concordat, there is also the possibility of having a church wedding that is legally recognized. In such cases, the officiating priest performs the civil ceremony at the beginning of the religious service.
It is also possible to request only a religious wedding, which, however, is not legally binding. The church requires additional steps that must be followed.

Free wedding ceremony and symbolic ceremony
A purely free wedding ceremony in the mountains or on the beach, despite its beauty and uniqueness in Italy, is not legally binding, but only a symbolic gesture. At most, it can be considered a dreamlike addition to a civil wedding, i.e., a symbolic ceremony. In this case, the legal marriage is performed in the home country or in an Italian registry office. Afterwards, a purely representative wedding ceremony takes place in Italy. The advantage of this is, on the one hand, the possibility of freely choosing a location—such as the vineyards in the Chianti region—and, on the other hand, the possibility of having the “wedding ceremony” performed by a friend or relative. This creates a unique and individual celebration. The absence of legal ties also creates a relaxed atmosphere for the couple and their guests.
